NutriSync™ LLC ("NutriSync™," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy ("Privacy Policy") explains how we collect, use, disclose, and safeguard your information when you join our Waitlist, access our website available at nutrisyncllc.com ("Site"), use the NutriSync mobile application (the "App"), and/or use related services as may be made available (collectively, the "Services").

By using our Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use our Services. This Privacy Policy is binding on all those who access the Services, whether acting as an individual or on behalf of an entity, including you and all persons, entities, or digital engines of any kind that harvest, crawl, index, scrape, spider, or mine digital content by an automated or manual process or otherwise.

This Privacy Policy is incorporated into our Terms of Service. Capitalized terms used in this Privacy Policy but not defined shall have the meanings set forth in the Terms.

At our discretion, we may change this Privacy Policy to reflect updates to our business processes, current acceptable practices, or legislative or regulatory changes. 1. Waitlist and Beta Program Information

  • Email Address: Collected when you join our Waitlist for participation in a Beta Program.
  • Marketing Preferences: By providing your email address, you consent to receive email updates about our Services (including participation in our Beta Program).
  • Referral Information: Whether you were referred by another user.
  • Analytics Data: Engagement metrics including how you found our website or heard about our App.

2. Personal Information You Provide when Creating and Maintaining an Account

  • Account Information: Email address, name, username, and password when you create an Account.
  • Profile Information: Age, gender, height, weight, fitness goals, dietary preferences.
  • Nutrition Information: Activity level, general physical condition relevant to nutrition (if voluntarily provided).

3. Information Collected Automatically

  • Usage Data: Features accessed, time spent in the App or using our Services, interaction patterns.
  • Device Information: Device type, operating system, unique device identifiers.
  • Log Data: IP address, browser type, pages visited, time and date of visits when visiting our Site or using our Services.
  • Time Zone Data: Time zone information to guide meal window optimization.

4. Meal and Nutrition Data

  • Meal Photos: Images of meals that you capture for meal analysis.
  • Nutritional Information: Calories consumed, macronutrient percentages, meal timing data.
  • Eating Patterns: Meal windows, frequency, and consistency data.

Additionally, third parties, including advertisers and analytics companies, may collect information, potentially including personal information, about your activities over time and across different websites. Such third parties may provide NutriSync with data collection, reporting, ad response measurement, and other analytical information.

Service and App Data

  • To provide and maintain our App and Services.

  • To send you publications, marketing or other information that may be of interest to you.
  • To personalize your meal windows and nutritional recommendations.
  • To analyze your meals using artificial intelligence and provide nutritional insights.
  • To track your progress toward your goals.
  • To send you notifications about meal times and App or Service updates.

  • To improve our App, Services, and related tools.
  • To detect, prevent, and address technical issues.
  • To prevent and investigate fraud or potential violations of our terms, conditions, and policies.

Artificial Intelligence

Certain of our Services may generate or analyze content through the use of artificial intelligence enabled or enhanced technologies, including without limitation, self-improving language and content models, machine learning software and algorithms, training improvement models, image recognition and categorization, and/or other functionalities as applicable. Results, analyses, or summaries generated by such Services may be derived from the reports, images, records, content, and other material that has been furnished by you.

Artificial intelligence enabled or enhanced mechanisms remain subject to ongoing evolution and refinement. NutriSync remains committed to constantly improving our Services to increase accuracy, reliability, and safety. Artificial intelligence technologies and functionalities remain dynamic in nature; as such, use of Services that include such technologies may provide results or analyses to you that do not accurately reflect details concerning applicable people, places, or facts. Your reliance upon any information obtained or used by you from our Services is solely at your own risk.

When you use artificial intelligence enabled or enhanced Services, you acknowledge and agree that:

  • Any results, outputs, or analyses from such Services may not always be 100% accurate. You should not rely on any such results, outputs, or analyses as a source of truth or 100% factual information, or as a substitute for professional advice or your own judgment.
  • You must evaluate results, outputs, and analyses for accuracy, appropriateness, and relevancy before using or sharing any results, outputs, and/or analyses that may derive from artificial intelligence enhanced or enabled Services.
  • NutriSync (or our third-party artificial intelligence processing vendors) may not be able to fully delete information submitted through our Services or restrict further processing of any information that is collected or processed in connection with your use of our Services.

NUTRISYNC EXPRESSLY DISCLAIMS ALL LIABILITY IN RESPECT OF ACTIONS TAKEN OR NOT TAKEN BASED ON ANY ARTIFICIAL INTELLIGENCE ENABLED OR ENHANCED SERVICES OR THE CONTENTS OF THE RESULTS, OUTPUTS, OR ANALYSES PREPARED IN CONNECTION THEREWITH.

Data Storage and Security

We implement appropriate technical and organizational security measures designed to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Although we will strive to use commercially acceptable means to protect the personal information you provide to us, we advise that no method of electronic transmission or storage is 100% secure, and no one can guarantee absolute data security. Any transmission of personal information is at your own risk. By using the Services, you acknowledge and accept these risks.

We will comply with laws applicable to us in respect of any data breach. You are responsible for selecting any password and its overall security strength, ensuring the security of your own information within the bounds of our services.

If your personal information is no longer required for the purposes described above, we will delete it or make it anonymous by removing all details that identify you.   • AI Processing: Meal photos are processed for nutritional analysis by Google's Gemini Models and through Firebase AI Logic.
  • Legal Requirements: When required by law or to respond to legal process (e.g., with courts, tribunals, regulatory authorities, and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise, or defend our legal rights).
  • Protection of Rights: To protect the rights, property, or safety of NutriSync, our users, or others.
  • Business Transfers: In connection with a merger, acquisition, sale of assets, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
  • Aggregated Data: We may share fully aggregated, anonymized data that can no longer identify you personally or be combined with other data sets to do so.

In addition, we will disclose information about you when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity, if disclosure is necessary to protect the vital interests of a person or the public, to protect our property, Services and legal rights, to prevent fraud against NutriSync, our Services, our community, or business partners, and to support auditing, compliance, and corporate governance functions.

Your Privacy Choices

NutriSync values your privacy. Please see further details below for instructions on how to correct and delete information in our App.

How to Correct or Delete Your Information

  • Correction: You can directly edit your profile, meals, and settings in the App at any time. Go to Settings > Profile to update your information.
  • Deletion: Go to Settings > Account > Delete Account & Data. Except as otherwise provided for herein, this will permanently delete your account information from our systems.
  • Withdraw Consent: By using NutriSync, you agree to artificial intelligence processing as a condition of Service. If you no longer consent to use of artificial-intelligence-enhanced or -enabled features, you must delete your account.

Children's Privacy

Our Services are not intended for individuals under 18 years of age. We do not knowingly collect personal information from children under 18. By accessing or using the Services, you represent that you are at least 18 years old. If you do not meet this age requirement, then you must not access or use the Services.

If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us through one of the methods listed under "Contact Us" below. If we become aware that we have collected personal information from a child, we take reasonable steps to remove that information from our servers.

International Users

The Services are intended solely for use by individuals located in the United States. If you visit the Services, your information, including personal information, may be transferred to—and maintained on—computers located in the United States, where the data protection laws may differ from those where you reside.   • Firebase (Google): For authentication, database, and storage.
  • Google Firebase AI Logic: For meal analysis and AI features.
  • Payment Processors: For future App purchases and subscriptions.

Acknowledgment

To the extent that you provide or transmit any information, including, but not limited to, any personal information and any information that identifies any other individual, to NutriSync or our third-party service or data providers, licensors, or distributors ("Representatives") through the Services, you warrant that: (a) you are providing or obtaining only your own information or the information of others which you are authorized to provide to third parties and/or obtain from third parties on their behalf; and (b) the use of such information by NutriSync and its Representatives will not infringe upon or misappropriate the intellectual property rights or otherwise violate the rights of any third parties.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. You are advised to review this Privacy Policy periodically for any changes.
